Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first informant report but according to prosecution case itself, the name of petitioner was disclosed by the local people.

It would appear that in course of investigation, the petitioner was arrested but nothing was recovered from his conscious position nor was he put on Test Identification Parade.
