JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This is an application for grant of anticipatory bail in connection with Rajnagar P.S. Case No. 55 of 2019, disclosing offences under Sections 147, 148, 323, 341, 379, 307, 504, 506 and 302 of IPC.

As per F.I.R. there is allegation that petitioner assaulted the informant by road and when the father-in-law came to save her, indiscriminately she was assaulted by Jagdeo Ram and vishwanath Ram by lathi, causing injuries and she was taken to hospital and she was unconscious. It further appears that later on, father-in-law died and as such, Section 302 of IPC has also been added.

Submission of the learned counsel for the petitioner is that even according to the F.I.R. there is no allegation against

Patna High Court CR. MISC. No.48694 of 2019(2) dt.05-08-2019 2/2 this petitioner of assault to the deceased and there is allegation against the petitioner of assault to the informant and the injuries are simple in nature.

Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, they have opposed the prayer for anticipatory bail of the petitioner. However, they have admitted that there is no allegation against this petitioner of assault to the deceased.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.,-1st, Madhubani, in connection with Rajnagar P.S. Case No. 55 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
