1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 401 of 2025 registered for the offence under section 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 352, 351(2), 351(3) of the B.N.S. 2023 and Section 27 of the Arms Act.

3. As per the F.I.R. on 18.03.2025 in the morning the informant along with other street boys of his colony and adjoining colonies were playing cricket. In the meantime at about 11:30 Hrs the petitioner - Bullu Singh @ Abhijeet along with other four F.I.R. named accused persons and twenty unknown persons appeared on the scene armed with plastic

Patna High Court CR. MISC. No.48090 of 2025(2) dt.11-08-2025 2/3 pipes. The petitioner / Bullu Singh was having a pistol in his possession. They started to take away one boy namely Sittu Kumar. It is further alleged that when the informant opposed, the petitioner made a targeted firing at the informant with an intention to kill him but the informant had a narrow escape. The petitioner again tried to fire but it misfired. Thereafter he hit the informant on his head by the butt of the pistol.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence in the manner alleged. He submits that the petitioner has falsely been implicated in this case due to enmity and local village politics. He further submits that the occurrence took place on a trivial issue during the game of cricket. He next submits that no incriminating article has been seized from the possession of the petitioner. There is no search and seizure from the place of occurrence which supports the exaggerated version of the informant.

Regard being had to the submission made by the parties, taking into consideration the fact that there is specific allegation against the petitioner of making targeted firing at the informant , assault made by the butt of the pistol on the head of the informant and the fact that petitioner has two criminal

Patna High Court CR. MISC. No.48090 of 2025(2) dt.11-08-2025 3/3 antecedents, as such, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
