The petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code. The petitioner Raj Kumar Sahni @ Santosh Sahni and another accused were apprehended and one stolen motorcycle is said to have been recovered.

It is submitted that the stolen motorcycle was not recovered from the conscious possession of the petitioner. The motorcycle was recovered from near a Hanuman temple. Similarly situated co-accused has already been enlarged on bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.42269 of 2015 (2) dt.16-09-2015 2/2 Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Pipra Kothi P.S. Case No. 69 of 2015.
