Petitioner, already in custody, seeks bail in connection with G.O. 92/2017, registered under Section 30 (A) of Bihar Prohibition and Excise Act, 2016.

The allegation in brief is that 22.500 liters of Nepali Saufi wine was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that nothing has been recovered from his possession but the petitioner has no criminal antecedent and the petitioner is in custody since 15.05.2017.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.4971 of 2018 (2) dt.31-01-2018 2/2 the petitioner, Bhanu Rauit, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge- II cum- Special Judge, Excise Act, Sitamarhi in connection with G.O. 92 of 2017.
