JUSTICE ARUN KUMAR ORAL ORDER 21-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Beur PS Case No. 149 of 2017 registered under Sections 302, 120B of the IPC and Section 27 of the Arms Act.

The allegation in brief is that the informant's husband was killed while he had gone somewhere and suspicion is raised that the petitioner, who was cousin father-in-law, and other co-sharers have eliminated the deceased to grab the landed property as he was issueless.

Learned Counsel for the petitioner submits that except raising suspicion against the petitioner there is no other material against him, petitioner is own brother of the father-in-law of the informant, he has no criminal antecedent and the police has completed investigation against the petitioner. Having considered the said facts and circumstances, the petitioner, namely, Krishna Rai @ Krishna Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge VIII Patna in connection with Beur PS Case No. 149 of 2017.
