JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but none has seen the actual killing of the deceased. In course of investigation, the informant as well as her brother claimed that some days prior to the alleged occurrence petitioner had committed rape on informant and when the informant's husband came to know about the aforesaid incident, he became annoyed and a quarrel had taken place between the petitioner and deceased and after that petitioner and his associates committed the murder of the deceased. The investigation has already been completed and moreover, father of the deceased has also lodged criminal case
Patna High Court Cr.Misc. No.42693 of 2015 (3) dt.21-12-2015 2/2 against the informant as well as her other family members in respect of death of his son.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya ( Banjariya) P.S.Case No. 244 of 2015.
