The petitioner seeks bail in a case registered under Sections 395/397 of the Indian Penal Code.
Prosecution case in short is that while the informant along with one another was returning his home from bank with money, meant for making bank draft, in the way, the accused persons being armed with deadly weapons, intercepted him and snatched the bag containing Rs. 2,70,000/-.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 30-08-2018. Patna High Court CR. MISC. No.48046 of 2019(2) dt.01-08-2019 2/2 taker of lichi orchard. Due to previous enmity, he has been made accused by the informant. There is no recovery of any incriminating article from possession of the petitioner. The other co-accused with similar allegation have been granted bail by this court as well as by coordinate benches of this court vide orders dated 12-04-2019, 26-02-2019 and 12-06-2019 passed in Cr. Misc. Nos. 11555 of 2019, 11537 of 2019 and 26490 of 2019.
On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Naugachia, Bhagalpur in connection with Sessions Trial No. 805 of 2018 (arising out of Bihpur (Jhandapur) P.S.
