Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable u/s 147, 149, 341, 448,

Patna High Court CR. MISC. No.50181 of 2022(2) dt.03-01-2023 2/3 323, 324, 354(B), 379, 504 and 506 of the Indian Penal Code. As per prosecution case, the petitioners armed with lathi, danda and knife entered the house of the informant under conspiracy and assaulted the informant's wife and daughter with the intent to kill. It further alleged that accused persons disrobed the wife of the informant, snatched away mangalsutra weighing eight bhar from her, stole Rs. 25,000/- from the house and fled away.

Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case due to previous land dispute. There is general and omnibus allegation against the petitioners. The petitioners have no criminal antecedent as stated at para 3 of the bail petition. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Darbhanga in connection with Moro P.S. Case No. 17 of 2022, subject to

Patna High Court CR. MISC. No.50181 of 2022(2) dt.03-01-2023 3/3 conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

This application stands allowed.
