JUSTICE PARTHA SARTHY ORAL ORDER 26-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Salkhua (Banma Ithari O.P) P.S. Case no. 175 of 2020 registered under sections 25(1-AA), 25(1-B)(a), 26 and 35 of the Arms Act. As per allegation in the FIR, on a raid being conducted large quantity of arms and ammunition were recovered from the house of Soman Kumar.

It is submitted by learned counsel for the petitioner that although the petitioner was arrested from near the house of Soman Kumar, however, from the seizure list it would transpire that only a mobile phone has been recovered from his possession. No arms or ammunition is stated to have been

Patna High Court CR. MISC. No.5371 of 2021(2) dt.26-03-2021 2/2 recovered from his possession. He is in custody since 8.8.2020 and has no criminal antecedent.

The application for bail is opposed by learned APP for the State. .

Having heard learned counsel for the parties and in the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Salkhua (Banma Ithari O.P.) P.S. Case no. 175 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa.
