2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
3. Allegation against this petitioner is of killing the daughter of the informant due to non-fulfillment of demand of dowry.
4. Petitioner is father-in-law of the deceased.
5. It is submitted that there is general and omnibus allegation against the petitioner. Petitioner is separate in mess and property and he is not concerned with the family affairs of the deceased. Thrust of accusation is against husband of the
Patna High Court CR. MISC. No.50450 of 2023(2) dt.17-08-2023 2/2 deceased who is already in custody. Petitioner has got clean antecedent.
6. Learned counsel for the informant vehemently opposes the bail application and submits that there is specific allegation against this petitioner that he along with other accused persons committed murder of daughter of the informant.
7. Considering the fact that thrust of accusation is against husband of the deceased who is already in custody, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-XXVII, Patna in connection with Sessions Trial No. 465 of 2023 arising out of Digha P. S. Case No. 708 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
