====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-12-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.
Heard the learned counsel for the petitioner as well as learned APP for the State.
In this case, the petitioner is seeking regular bail in connection with Begusarai Town (Ratanpur-O.P.) P.S. Case No. 317 of 2022, registered for the offences punishable under Sections 307, 387, 120(B), 504, 506, 34 of the Indian Penal Code and 27 of the Arms Act.
Aarti Kumari, who is the informant has mentioned that her sleeping was interrupted at the sound of fire shot. She saw in her camera that the petitioner was abusing his
Patna High Court CR. MISC. No.49544 of 2022(2) dt.16-12-2022 2/3 husband and devar Sourabh Kumar and also opening fire shot. The further allegation is that the petitioner and co-accused Naval Singh were making pressure on the husband and devar of the informant to join their gang. Naval Singh has also demanded a ransom of Rs. 50,000/- from the informant from jail. Learned counsel for the petitioner has submitted that the entire allegation is false. As a matter of fact, two days prior to the occurrence, the members of prosecution side including the husband and devar of the informant had demanded ransom of Rs. 4 lacs from co-accused Naval Singh and in this regard, he has lodged FIR on 28.05.2022. The present FIR was lodged on 30.05.2022 only in retaliation of the FIR lodged by the co-accused, Naval Singh.
The learned counsel for the petitioner has also submitted that the petitioner is under custody since 01.06.2022. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Begusarai Town (Ratanpur- O.P.) P.S. Case No. 317 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
