Versus
1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Sunil Kumar Yadav, Advocate For the Opposite Party/s : Mr. Ashok Kumar Singh, A.P.P. ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-01-2018 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The petitioner is daughter-in-law of deceased. Suspicion is that the petitioner along with co-accused Kallu Razak, allegedly, committed murder of her mother-in-law by throttling her.
Learned counsel for the petitioner submits that there is no eye-witness of the occurrence and the parties have entered into a compromise.
Learned counsel for the State opposed the prayer for bail on the ground that the Doctor has found a case of
Patna High Court Cr.Misc. No.3248 of 2018 (3) dt.29-01-2018 2/2 throttling of the deceased and there was no one else in the house when murder was committed, except the petitioner and others. The case diary would further reveal that the petitioner has illicit relation which was opposed by the deceased that is why she was murdered.
Considering the entire facts and circumstances as well as circumstantial evidence aforesaid, I am not inclined to enlarge the petitioner on bail in connection with Delha P.S. Case No. 125 of 2017 pending in the court of learned 7th Additional Chief Judicial Magistrate, Gaya.
Let the learned trial court expedite and conclude the trial preferably within nine months.
