Petitioner, already in custody, seeks bail in connection with Banmankhi P.S. Case No.135 of 2017, registered under Sections 341, 323, 504 and 376/511 of the Indian Penal Code. Allegation in brief is that in the midnight the petitioner entering into the house of the informant made an attempt of rape to deaf and dumb daughter-in-law of the informant. It is submitted that a detailed description is given but the informant was not the witness and only due to boundary dispute, as the house of the petitioner is situated in neighbourhood of the informant, the petitioner has been implicated in this case and he is in custody since 09.07.2017.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.17332 of 2018(2) dt.28-03-2018 2/2 petitioner Dilip Rishideo is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, Purnia in connection with Banmankhi P.S. Case No.135 of 2017.
