Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 307, 353, 412, 414, 147, 148, 149 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

Submission is that the arrested accused persons from whose possession fire arm etc. was recovered confessed before the police and they disclosed name of the petitioner as co-culprit though the petitioner was not there. Petitioner was not there at the time of their arrest. Petitioner is in custody since 05.09.2020. Investigation of the case is already complete. Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.5404 of 2021(2) dt.13-04-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Salimpur P.S. Case No. 182 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
