2. The petitioners apprehend arrest in connection with Tilkeshwar P.S. Case No. 139 of 2025 lodged on 22.11.2025, for the offence punishable under Sections 126(2), 115(2), 109(1), 76, 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.
3. As per the prosecution, FIR has been lodged against 19 named accused persons including the present petitioners. The allegation in the FIR is that all the accused persons in connivance with each other have started scuffling with other party when panchayati was going on. Thereafter firing has been

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He submits that the petitioners and informant are resident of same village and they are well known to each other. Counsel submits that for the same date and place of occurrence dated 20.11.2025, there are case and counter case filed from both the sides. The case filed by the petitioners' side is annexed as Annexure-P/2 in which 15 persons have been made accused and the allegation of firing is there. Counsel submits that a title suit bearing Title Suit No. 502 of 2025 is pending between the parties. He further submits that petitioner nos. 1, 3 and 4 have three criminal antecedents each and in all the cases, they are on bail, whereas, petitioner no. 2 has two criminal antecedents and in both the cases, he is also on bail.
5. Learned APP for the State opposes the prayer for bail of the petitioners but fairly submits that for the same date and place of occurrence, there are case and counter case filed from both the sides and a title suit is also pending between the parties.
6. As such, in the present facts and circumstances of this case, let the above named petitioners be released on bail on being satisfied by the Trial Court that the petitioners are not

No.47907 of 2026(2) dt.22-07-2026 3/3 absconding in any of the cases pending against them whose details are mentioned below, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of Judicial Magistrate 1st Class, Biraul, Darbhanga, in connection with Tilkeshwar P.S. Case No. 139 of 2025, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.
7. Pending cases against the petitioner nos. 1, 3 and 4 are as follows:- (I)- Kusheshwarasthan P.S. Case No. 162 of 2014 (II)- Tilkeshwar P.S. Case No. 306 of 2023 (III)- Tilkeshwar P.S. Case No. 102 of 2025 7.1. Pending cases against the petitioner no. 2 are as follows:- (I) Kusheshwarasthan P.S. Case No. 162 of 2014 (II) Tilkeshwar P.S. Case No. 102 of 2025.
