JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the investigating officer came to know that petitioner and one co-accused, Neyaz Dewan made confessional statement in Choutarwa P.S. Case No. 209 of 2014 and accepted their involvement in the present case. The stolen coils were also recovered from possession of the petitioner and coaccused, Neyaz Dewan in Choutarwa P.S. Case No. 209 of 2014 and accordingly, petitioner and co-accused, Neyaz Dewan were remanded in the present case.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.41428 of 2015 (3) dt.21-12-2015 2/2 petitioner has already been released on bail in Choutarwa P.S. Case No. 209 of 2014 and similarly, co-accused, Neyaz Dewan has also been granted privilege of bail by a co-ordinate Bench of this court in the present case. It is also pointed out by him that earlier petitioner was made accused in four cases but when he remanded in Choutarwa P.S. Case No. 209 of 2014, the police remanded him in some other cases also.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha (Bhairoganj) P.S.
