Learned counsel for the petitioners are expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioners are apprehending his/their arrest in
Patna High Court CR. MISC. No.5602 of 2021(2) dt.29-11-2021 2/3 connection with Sasaram Nagar (Darigo) P.S. Case No. 305/2020 for the offence registered under Sections 147, 148, 149, 341, 323, 307, 504 and 506of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case in brief is that petitioners along with 8-10 accused persons came with weapons and assaulted the informant.
Learned counsel for the petitioners submits that petitioner is innocent and he has falsely been implicated in the present case. It is further submitted that the allegation of assault is against the three co-accused persons and not against these petitioners. It is further submitted that name of the petitioners have been included in the first information report to make pressure for withdrawing the earlier case filed by the petitioners against the informant and others. It is further submitted that the petitioners have no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of his/their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief
