JUSTICE SUDHIR SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 17.04.2015 in connection with Sherghati P.S. Case No. 98 of 2015 for the offences instituted under Sections 25(1-b)a and 26 of the Arms Act.

It is alleged that one country made pistol alongwith three live cartridges was recovered from possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.04.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. One country made pistol with three live cartridges is said to have been recovered from

Patna High Court Cr.Misc. No.42147 of 2015 (3) dt.15-10-2015 2/2 possession of the petitioner. Compliance of Section 100 Cr. P.C. has not been made. Recovery is denied by the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Sherghati, Gaya, in connection with Sherghati P.S. Case No. 98/2015.
