JUSTICE PARTHA SARTHY ORAL ORDER 26-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Chandan P.S. Case no. 135 of 2017 registered under sections 147, 148, 149, 121, 121A and 120B of the Indian Penal Code, sections 3 and 4 of the Explosive Substances Act, 1908, sections 16, 17, 18, 19, 20, 21 and 22 of the U.A.P.A Act and section 17 of the C.L.A Act. As per allegation in the FIR, on an accused namely Sadhu Khaira being apprehended, on questioning he disclosed that explosive substance had been supplied to him by the petitioner herein.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and

Patna High Court CR. MISC. No.5369 of 2021(2) dt.26-03-2021 2/2 concocted. Except for the confessional statement of a coaccused made before the police, there is no other material against the petitioner who is a lady and is in custody since 24.11.2017.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations together with period in custody, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Chandan P.S. Case no. 135 of 2017 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
