JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner, State and the counsel appearing on behalf of the University. Mr. Uma Shankar Prasad, Sr. counsel appearing on behalf of the petitioners submits that respondents-University is required to complete process of selection by constituting a selection committee in terms of the Bihar State University Act,
Patna High Court CWJC No.4039 of 2017 (3) dt.06-12-2017 2/2 1976 amended from time to time particularly, the amendment Act, 2013, whereby the University is required to constitute a selection committee for the purpose of appointment of teachers in affiliated colleges. The college in question is permanently affiliated with J.P. University and, as such, the University is required to perform statutory obligation in the matter so that selection committee may proceed in the matter of selection and appointment of Assistant Professor and other teaching staff in terms of the amended provision of the Bihar State University Act.
From the documents enclosed with this writ petition as well as the averments made therein, it appears that the matter is pending at the level of the University and except correspondence in between the petitioner and the University nothing positive has been done. Under the aforesaid circumstances, the writ petition is disposed of with direction to the Registrar, J.P. University to take steps for constitution of the selection committee at the earliest, preferably within a period of 60 days from the date of receipt/production of this order.
