For the Appellant/s : Mr. Basant Choudhary, Sr. Advocate Mr. Santosh Kumar, Advocate For the State : Mr. Yogendra Prasad Sinha-AAG-7 =========================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE And HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date: 22-02-2017 The challenge in the present Letters Patent Appeal is to an order passed by a learned Single Bench of this Court on 3.10.2016 wherein the Court directed that the disciplinary proceedings be concluded within three months. The Court also noticed that there is a criminal proceeding initiated against the appellant and charge sheet has been filed.
The grievance of the appellant is that he continues to be under suspension, though there is a direction to conclude the
Patna High Court LPA No.2064 of 2016 dt.22-02-2017 2/2 disciplinary proceedings within three months. We find that the direction is to conclude the enquiry expeditiously, failing which liberty was given to the appellant to seek revocation of suspension.
We do not find any error in the order passed by the learned Single Bench which may warrant interference in the present intra-Court appeal. The appeal is, thus, disposed of. Needless to say that the disciplinary proceedings are expected to be completed expeditiously and if not completed by now, will be completed within another three months time from the date of copy of the order is received by the respondents.
