Petitioner, already in custody, seeks bail in connection with Atri P.S. Case No.143 of 2017, registered under Sections 341, 323, 498A, 506 and 34 of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the allegation against the petitioner is general though he is husband and in custody since 28.09.2017 but ready to give Rs.2000/- per month as maintenance to his wife and one child. Learned counsel for the State submits that allegation is specific against the petitioner not only of cruelty but of solemnizing second marriage and the informant was ousted while she was pregnant.

No.5013 of 2018(2) dt.31-01-2018 2/2 Having considered the said facts and circumstances, petitioner Roushan Kumar @ Roushan Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Gaya in connection with Atri P.S. Case No.143 of 2017 with condition that the petitioner will pay monthly maintenance allowance of Rs.2000/- to his wife and that shall be deposited in the bank account of the informant which requires to be furnished by the informant, until such period a draft of Rs.2000/- will be deposited in the court below by 15th day of each succeeding month.
