The petitioner seeks quashing of an order, dated 25.01.2017, issued by the Deputy Regional Manager, Regional Office, Motihari, whereby he has been put under suspension. The petitioner, at the relevant point of time, was working as a Class-IV employee. The allegation against him is of using a abusive language. The petitioner has also sought quashing of

In order to make out a case against the order of suspension, the petitioner has alleged mala fide against officers of the Bank. In my view on perusal of memo of charge, no case for quashing of the memo of charge in a proceeding under Article 226 of the Constitution of India is made out. A disciplinary proceeding has already been initiated against the petitioner. The petitioner may have genuine grievance against continuance of the order of suspension for an indefinite period during the pendency of the disciplinary proceeding.

In that view of the matter, I dispose of this application with a direction to the Regional Manager, Central Bank of India, Regional Office Baluatand, Motihari, East Champaran, to conclude the departmental enquiry within a period of six months from the date of receipt/production of a copy of this order. The Court expects the petitioner to cooperate in course of the departmental enquiry.
