JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-01-2023 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends her arrest in connection with Silao P.S. Case No. 73 of 2022, registered for the offences punishable under Sections 420 467, 468, 471, 120 B of the Indian Penal Code. As per allegation, the petitioner became successful in securing the job of Panchayat Teacher after producing some forged certificates.

Learned counsel for the petitioner has submitted that the petitioner is innocent and was selected for the post of Panchayat Teacher after all the formalities conducted by the Selection Committee. The High Court had fixed amnesty period for resignation

Patna High Court CR. MISC. No.49585 of 2022(2) dt.12-01-2023 2/2 from the job and it was only fault of the petitioner that she could not resign within amnesty period.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of her arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S. Case No. 73 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C. At the time of surrender, the petitioner will file an affidavit that she will not claim for the post for which she was selected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
