JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel for the State. Petitioners apprehend arrest in connection with Dhangai P.S. Case No. 7 of 2016 registered under Sections366A of the Indian Penal Code. It is alleged that accused persons came to the village of informant and kidnapped her daughter Pinki Kumari with intention of marriage. It is further alleged that when informant approached them, they abused him and threatened to kill him.
Learned counsel for the petitioner submits that it is a matter of love affair and she on her own left the house with
Patna High Court Cr.Misc. No.13674 of 2016 (5) dt.16-01-2017 2/2 intention of marriage. Petitioners have no concern with the incidence. It is further submitted that the girl has written a letter to the effect that they have already married and are living as husband and wife. It is further submitted that during the pendency of this application, Kapil Singh @ Kapilmuni Yadav, the main accused and presently husband of the victim, has been granted bail by the Court below in A.B. No. 806 of 2016 on 13.06.2016.
Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri N.K. Srivastava, Judicial Magistrate, Bhojpur, Ara in connection with Dhangai P.S. Case No. 7 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
