The petitioner seeks bail in a case registered for the offence punishable under Section 304 (B)/34 of the Indian Penal Code.

Allegation against the petitioner is of committing torture upon the victim due to non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. Post mortem report does not show any injury of the victim.

Heard learned APP and perused the Viscera report, no Metallic, Alkaloidal, Glycosidal, pesticidal and volatile poison could be detected in the contents of plastic jar. The petitioner is in custody since10.05.2018 and has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-IV, Aurangabad, in connection with Tandwa P.S. Case No. 27 of 2018, subject to the condition is that the petitioner is directed to cooperate in the disposal of trial as and when required.
