JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-03-2021 Heard Mr. Gajendra Kumar Singh, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Kako PS Case No. 191/2020 registered for the offence punishable under Sections 379, 411 of the IPC.

The allegation, as per First Information Report, is that on 17.09.2020 during course of verification of Sanha, informant along with other police officials reached at village, Dighiyaper and found that one person, seeing the police, started fleeing away, but was apprehended. Upon query, he disclosed his name as Vikash Kumar. It has further been alleged that two Apache Motorcycles were seized which were lying outside the house of

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. Learned counsel further submits that from perusal of the seizure list, it would be evident that the motorcycles in question were lying in front of the house of his Sasural and the same have not been recovered from the possession of the petitioner. Learned counsel next submits that petitioner is in custody since 19.09.2020 having no criminal antecedents and charge-sheet in the matter has already been submitted.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 19.09.2020 having no criminal antecedents and charge-sheet in the matter has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, VIKASH CHAUDHARY @ VIKASH KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Kako PS Case No. 191/2020.
