JUSTICE PURNENDU SINGH ORAL ORDER 24-04-2023 Heard Mr. Vinay Kumar Mishra, learned counsel appearing on behalf of the petitioner and Mr. Sanjay Kumar Tiwary, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in connection with Complaint Case (CR) No. 762 of 2021 (T.R. No. 1255 of 2022) registered under Section 341, 323, 498(A) of the Indian Penal Code.
3. Considering the fact that petitioner and Opposite Party No. 2 are husband and wife and they have mutually settled the dispute between them. It has been informed that the couple

4. In above view of the matter, the petitioner has made out a case to be released on anticipatory bail.
5. Court below is directed to release the petitioner on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate-1st, Darbhanga in connection with Complaint Case (CR) No. 762 of 2021 (T.R. No. 1255 of 2022), subject to the condition as laid down under Section 438(2) of the Cr.P.C.
6. Accordingly, the present bail application is consigned.
