Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 419, 420, 414 and 120(B) of the Indian Penal Code, registered in connection with Nawada (Town) P.S.Case No. 802 of 2020.
One Deepak Kumar was arrested with a number of mobile sets and SIM cards. He disclosed the police party that co-accused Satyendra Kumar @ Chhotu had provided the ATM cards to him.
The learned counsel for the petitioner has submitted that the name of the petitioner has figured in the confessional statement of co-accused Deepak Kumar. Same Deepak Kumar has also implicated him in Chhatisgarh P.S.Case No. 02 of 2020,
Patna High Court CR. MISC. No.50217 of 2022(2) dt.16-01-2023 2/2 in which case the petitioner has been granted bail. He has submitted further that the case of the petitioner is on better footing than that of co-accused Satyendra Kumar @ Chhotu, who has been granted anticipatory bail by a co-ordinate Bench of this Court, vide Cr.Misc. No. 42417 of 2021. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Prashant Kumar, learned Judicial Magistrate 1st Class, Nawada in connection with Nawada (Town) P.S.Case No. 802 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
