2. Counsel appearing on behalf of the petitioner has drawn the attention of this Court to the orders passed by a Co-ordinate Bench of this Court in C.W.J.C. No. 13736 of 2006, C.W.J.C. No. 2986 of 2012 and C.W.J.C. No. 5893 of 2015 and submits that the writ application may be disposed of with a direction to the respondents to consider the case of the petitioner in the light of the decision of this Court contained in Annexures- 2, 3 and 4.
3. Counsel for the University submits that the petitioner may file representation before the Vice-chancellor of the
Patna High Court CWJC No.3561 of 2017 dt.05-12-2017 2/2 University and if the representation is filed by the petitioner before the Vice-chancellor of the University, the respondent Vice-chancellor will look into the grievance of the petitioner and pass reasoned and speaking order.
4. In view of the above, the writ application is disposed of with a direction to the petitioner to file representation before the Vice-chancellor of the University along with a copy of this order within a period of one month from today. In case, such representation is filed, the Vice-chancellor shall consider the case of the petitioner and pass a reasoned and speaking order within a maximum period of three months form the date of receipt representation and in the event the Vice-chancellor finds substance in the claim of the petitioner, he shall ensure payment of monetary benefits arising out of such decision within a further period of two months.
