The petitioner seeks bail in a case registered under Sections 147, 148, 149, 342, 307, 302, 323, 337, 338 and 506 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner assaulted the father of the informant with lathi, danda and bricks, on account of which he sustained grievous injuries. He was taken to the Hospital for treatment, but on the way he died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.2.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.45871 of 2019(2) dt.24-07-2019 2/2 against the petitioner. General and omnibus allegation has been made. Neither any specific overt act is alleged against the petitioner nor any specific injury has been attributed against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. case No.03 of 2018.
