The petitioner apprehends his arrest in connection with Patliputra P.S. Case No. 205 of 2019, registered under Sections 457, 380, 411 and 413 of the Indian Penal Code. The accusation is that at the time of carrying the iron rod after committing theft from the work place of the informant, the police was informed then police came there and caught hold Subhash Kumar and Sudhir Poddar with three bundles of 10 mm and one bundle of 8 mm iron rod. On query, both persons disclosed the name of petitioner as their associate. Learned counsel for the petitioner submits that while co-accused, Subhash Kumar and Sudhir Poddar, who were

Patna High Court CR. MISC. No.46823 of 2019(2) dt.29-07-2019 2/2 apprehended by the police at the spot, disclosed the name of petitioner as their associates but they have not disclosed about the role of the petitioner in the alleged theft of iron rod and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XII, Patna, in connection with Patliputra P.S. Case No. 205 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
