JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offence punishable under Section 379 of the Indian Penal Code. As per prosecution case, stolen TMT bars have been recovered the courtyard of the house of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is next submitted that house in question was abundant. No incriminating material has been recovered from the conscious possession. Name of the petitioner transpired during course of investigation in the confessional statement of co-accused Amod Kumar.

Learned counsel for the State opposes the prayer for bail application submitting that stolen TMT bars have been

Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
