The petitioner seeks bail in connection with Sessions Trial No.723 of 2013, arising out of Halsi P.S. Case No.131 of 2012, registered under Sections 302/34 of the Indian Penal Code besides Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the prayer of the petitioner for grant of bail was rejected twice, lastly, vide order dated 19.02.2016 passed in Criminal Misc. No.1424 of 2016 by this Court with an observation that if the trial of the petitioner is not concluded within one year, the petitioner may renew his prayer for bail. Patna High Court Cr.Misc. No.9132 of 2018 (2) dt.14-03-2018 2/2 further submits that in spite of passing over for more than one year, the trial of the petitioner has not been concluded as yet and is still pending in the court of Additional Sessions Judge-I, Lakhisarai, for disposal. The petitioner is in custody since 21.01.2013.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, Lakhisarai, in connection with Sessions Trial No.723 of 2013, arising out of Halsi P.S. Case No.131 of 2012.
