JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-12-2022 At the outset learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition so far as petitioner no. 4, Shahansha is concerned.

Permission is allowed.

The anticipatory bail petition, in respect of petitioner no. 4, is dismissed as withdrawn.

Heard learned counsel for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323,

Patna High Court CR. MISC. No.49146 of 2022(2) dt.14-12-2022 2/2 307, 379, 504 and 506 of the IPC.

As per the prosecution case, all the accused persons assaulted the informant and his family members. Learned counsel appearing for the petitioners submits that the injuries caused caused to the informant and his family members are simple in nature. Both sides sustained inures. Learned counsel appearing for the informant vehemently opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner nos. 1, 2 and 3, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Tarabari P.S. Case No. 42/2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.

This application is accordingly disposed of.
