JUSTICE SUDHIR SINGH ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 457 and 380 of the Indian Penal Code. Allegation against the petitioner is to have committed theft in the shop of the informant.
It has been submitted on behalf of the petitioner that he is in custody since 13.7.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. The name of the petitioner has come on the basis of confessional statement of the co-accused. Two mobile phones are said to have been recovered from the possession of the petitioner but the same had not been put on T.I.P. to ascertain whether the same is stolen property or not. It is further submitted that the petitioner may be released after completion of seven months in custody from 13.7.2015.
On behalf of the State, it is submitted that petitioner is
Patna High Court Cr.Misc. No.42150 of 2015 (3) dt.17-12-2015 2 / 2 not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of seven months in custody from 13.7.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, at Motihari, East Champaran, in connection with Turkauliya P.S. Case no. 530 of 2015.
