JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Mahua P.S. Case No. 209 of 2019, disclosing offences under Sections 25(1-b)a, 26/35 of the Arms Act. Allegation as per F.I.R. is that police arrested one Rakesh Kumar and from his possession one country made pistol and more cartridge were recovered and he also disclosed that he along with petitioner had earlier looted the pick-up van and petitioner succeeded in fleeing away from the spot. Submission of the learned counsel for the petitioners is that so far as the case under Section 25(1-b)a, 26/35 of the Arms Act is concerned, no case is made out against the petitioners. They are ready to abide by any condition imposed upon them.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 209 of 2019,, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
