2. The petitioner seeks bail in Sidhwaliya P.S. Case No. 76 of 2024 registered for the offence punishable under Sections-30(a)(b) (c)(d) of the Bihar Prohibition and Excise Act.

3. It is alleged that on the tip off, the informant reached at the place of occurrence. Seeing the police party, four persons and one lady started fleeing away. Though the four persons managed to escape but the only lady was apprehended who disclosed her name as Rinku Devi. Thereafter, 15 litres country-made liquor has been recovered from three gallons from the place of occurrence.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. From the FIR, it is not clear that who was specially preparing and selling the

Patna High Court CR. MISC. No.51878 of 2024(2) dt.30-07-2024 2/2 liquor. No incriminating article has been recovered from possession of the petitioner. The petitioner is in custody since 03-05-2024.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances and submission of the parties, the petitioner named above, is directed to furnish bail bond in the court below after completion of six months in custody and on doing so, the petitioner shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge_XIII-cum-Special Judge, Excise-1, Gopalganj in connection with Sidhwaliya P.S. Case No. 76 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court. (Nawneet Kumar Pandey, J) A.K.V.//- U T
