The petitioner seeks bail in a case registered for the offences punishable under sections 302 and other allied sections of the Indian Penal Code, section 27 of the Arms Act and section 17 of the Criminal Law Amendment Act. The informant naming 37 persons has alleged that they all reached his village and killed his brother Mukesh Yadav, Damodar Yadav and his cousin Wakil Yadav @ Gong and also committed dacoity in the house.

It is submitted that no specific allegation is made against the petitioner. Similarly situated co-accused Bipin Ram, Pappu Ram, Kushi Manjhi, Chamak Manjhi, Gholtan Manjhi, Suresh Ram, Sunil Ram. Mahendra Das, Bino Manjhi and Arun

Patna High Court Cr.Misc. No.42885 of 2015 (2) dt.17-09-2015 Ram have already been enlarged on bail. The case of the petitioner stands on the same footing.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ad-hoc Additional Sessions Judge Vth, Lakhisarai in connection with Sessions Trial No. 397 of 2014 arising out of Surajgarha (Kajara) P.S. Case no. 98 of 2009.
