The petitioner prays for grant of bail in Madhepur P.S. case no.35/2018 registered for the offence punishable under sections 395, 397 of the Indian Penal Code and section 27 of the Arms Act.

As per prosecution case, on 7.4.2018 this petitioner along with co-accused persons committed dacoity in Mithilanchal HP Petrol pump at Madhepur and looted Rs 12,32,615 and gave bullet injury to one Lal Mohan Yadav. It is submitted on behalf of petitioner that petitioner is not named in the FIR. The name of the petitioner has come on the basis of confessional statement of co-accused. No

Patna High Court CR. MISC. No.59453 of 2021(3) dt.19-05-2022 2/2 incriminating article was recovered from the possession of the petitioner and he is in custody since 26.05.2019. Learned counsel for the State opposed the prayer for bail and submitted that petitioner has got criminal antecedent of similar nature.

Considering the criminal antecedent of the petitioner, prayer for bail of the petitioner is rejected. However, trial court is directed to expedite the trial of the petitioner. (Prabhat Kumar Singh, J) s.hassan/- U T
