No doubt, first information report was lodged in the year 2003 and the petitioner could be remanded in this case on 4.8.2015 but from perusal of the first information report, it is obvious that it was co-accused Md. Sabbir who had demanded extortion from the informant and the petitioner only advised the informant to give money as demanded by Md Sabbir.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Patna in Pirbahore P.S. Case no. 76/2003.
