This application for regular bail arises out of Raniganj P.S. Case No. 150 of 2018, disclosing offences punishable under Sections 302/34 of the Indian Penal Code. The petitioner is the husband of the deceased. The deceased was married to the petitioner nearly 12-13 years before the alleged date of occurrence. Mother of the deceased is the informant.

Learned counsel appearing on behalf of the petitioner has submitted that there is no material in the FIR, which could have been the basis for the informant to form an opinion that the petitioner might have killed the deceased. It transpires from the case diary that the materials collected in course of investigation

Patna High Court CR. MISC. No.48616 of 2019(5) dt.11-12-2019 2/2 suggest commission of suicide.

Be that as it may, in the absence of any direct material showing petitioner's involvement in commission of an offence, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Araria in Raniganj P.S. Case No. 150 of 2018.
