JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 11-08-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 354B, 504, 506 of the Indian Penal Code.
It is alleged that all the F.I.R named accused persons including the petitioner and 4-5 unknown assaulted the informant and other family members and made an attempt to outrage the modesty of the female members of the informant and also snatched silver chain and gold ear-rings.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.50803 of 2023(2) dt.11-08-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. There is no accusation of repeating the blow. Both sides were on inimical terms from before and there is a land dispute between the parties. The petitioner is languishing in custody since 08.04.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 170 of 2023.
