2. The petitioners seek bail in connection with Obra P.S. Case No. 503/2024, registered for the offence under Section 126(2), 115(2), 117(2), 118(2), 352, 351(2), 3(5) of BNS 2023.
3. The accused/petitioners are named in the F.I.R. and petitioner nos. 1 and 2 are in custody since 26.04.2025 and petitioner no. 3 is in custody since 28.04.2025.
4. As per FIR, the petitioners alleged to assault mother and father of the informant alongwith other co-accused persons, causing head and bodily injuries.
5. Learned Counsel appearing on behalf of the
Patna High Court CR. MISC. No.50155 of 2025(3) dt.31-10-2025 2/3 petitioners submitted that the allegation of physical assault against Kundan Yadav and Munna Kumar appears not available as per facial perusal of FIR, whereas as far petitioner no. 1, namely, Binod Yadav @ Vinod Kumar Singh is concerned, he alleged to assault the mother of the informant on her leg. It is submitted that the allegation as set out through FIR is prima facie not suggestive of the fact that the present is the case which falls under Section 326 of the IPC/118 of BNS. It is also submitted that the occurrence is free fight in nature, for which petitioners's side also lodged a case against the informant which was registered as Obra P.S. Case No. 507 of 2024. While concluding the argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence and, moreover, all petitioners are of clean antecedent.
6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of nature of injury and instrument which alleged to cause injury to mother of the informant as alleged through FIR, coupled with the fact that investigation of this case is already completed, where petitioner nos. 1 and 2 are in custody since 26.04.2025 and petitioner no. 3 is in custody since 28.04.2025,
Patna High Court CR. MISC. No.50155 of 2025(3) dt.31-10-2025 3/3 accordingly, all above named petitioners, are directed to be released on bail in connection with Obra P.S. Case No. 503/2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Aurangabad/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
