1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. No one appears on behalf of the informant.

3. The learned counsel for the petitioners, at the outset, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.2, namely, Babloo Yadav @ Arun Kumar as he was arrested during the pendency of the instant anticipatory bail application.

4. Permission is accorded.

5. Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.2, namely, Babloo

6. The petitioner nos.1, 3, 4 and 5 seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109(1), 303(2), 3(5) of the B.N.S.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that while he was returning along with his wife on a motorcycle to his home when they were intercepted by 15 named accused persons including women. Further, Umesh threatened with a gun saying that he has already instituted three cases in the police station, hence, would be killed and his land would be possessed. Thereafter, all the accused started assaulting them with lathi, danda and rod. Thereafter, Umesh took out his mobile while other accused persons took away Rs.50,000/- along with Mangalsutra and chain was snatched by Umesh. Further, on account of assault his both hands were injured but head was saved as the informant and his wife were wearing helmet. Further, his wife also suffered fracture of hand.

8. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that Aurangabad Town P. S.

Patna High Court CR. MISC. No.54674 of 2025(2) dt.30-08-2025 3/3 Case No. 139 of 2025 has been instituted by the side of the petitioners against the informant and his side. It is also submitted that there is land dispute in between the parties. It is next submitted that no doubt, one of the injuries has been opined to be grievous, but then, there is no specific allegation of assault against the accused persons and petitioners are not criminals.

9. Learned A.P.P., Mr. Rabindra Kumar, opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioner nos.1, 3, 4 and 5, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Muffasil P. S. Case No.161 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
