The petitioner who is in custody since 25.05.2019 has filed the instant application for grant of bail in connection with Laheri P.S. Case No. 03 of 2019 (District- Nalanda) registered for the offence punishable under sections 25(1-b)(a), 26 and 35 of the Arms Act.

As per the allegation in the FIR, from the room rented by this petitioner, a country made revolver and two cartridges of which one was live, was recovered. It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place and he is in custody since 25.05.2019 The application for bail was opposed by learned

No.47739 of 2019(3) dt.25-09-2019 2/2 APP for the State to submit that besides the recovery of incriminating articles, the petitioner has criminal antecedent of three cases of which two are under Section 395 of the I.P.C. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and as such the petitioner's application for bail is rejected.
