In view of the limited prayer made at the time of hearing, without going into the merits of the case, this writ application is being disposed of by granting opportunity to the petitioner to raise his grievance before the respondent no. 2, i.e., the State Election Commissioner, Bihar, Patna by filing fresh application which should be considered by it on its own merit and in accordance with law and the decision should be taken thereafter but not before granting reasonable opportunity to all the concerned including the private respondent expeditiously preferably within a period of three months from the date of receipt/production of a copy of this order.
