The petitioner is in custody in a case registered under Sections 302, 328 and 120(B) of the Indian Penal Code. The petitioner happens to be the brother-in-law of the wife of the deceased and allegedly the petitioner had illicit relation with the wife of the deceased. In course of investigation it has come that the deceased committed suicide by consuming poison as in-laws were not ready to send his wife with him. Moreover, after investigation police submitted charge sheet under Sections 306 and 120(B) of the Indian Penal Code.

Considering the facts and circumstances of the case as well as submissions of the parties, let above named

Patna High Court Cr.Misc.
