JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Panapur P.S. Case No. 75 of 2019, disclosing offences under Sections 304(B), 201 and 34 of the Indian Penal Code.
Petitioner nos. 1 and 2 are father-in-law and cousin father-in-law, petitioner no. 3 is mother-in-law and petitioner no. 4 is sister-in-law (gotani) of the deceased and allegation against them is of causing death of the deceased with respect to demand of dowry.
Submission of learned counsel for the petitioners is
Patna High Court CR. MISC. No.46454 of 2019(2) dt.26-07-2019 2/2 that as a matter of fact the deceased died due to illness and these petitioners, who are in-laws of the deceased have falsely been roped in the present case and after the death of the deceased, the informant has participated in the funeral but thereafter, he lodged this false case with ulterior motive. Moreover, no specific allegation has been attributed to the petitioners. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM -IV, Saran at Chapra, in connection with Panapur P.S. Case No. 75 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
